TERMS AND CONDITIONS OF SALE

These Terms and Conditions comply with UK legislation and apply exclusively to this website. We pride ourselves at Drumshack on efficiency and will make every effort to ensure your purchase with us is as safe, secure and pleasurable as possible.

PRICES
Prices payable for the goods you order is as set out on our web site at the time you place your order plus any charges for carriage as set out in the order form. All prices are inclusive of VAT where applicable. We must receive payment in full for the goods you order, and any applicable charges for carriage before your order can be accepted unless we have agreed otherwise in advance in writing.

DELIVERY
We aim to despatch any orders received form this site before 3.00pm same day where stock is available. In such cases where the product is not in stock we will notify you by email or telephone to confirm delivery times. We aim to deliver items not in stock at the time of ordering within 14 days. Promises are given in good faith and adhered to as far as possible but no responsibility is accepted for unforeseen delays subsequently arising. If for any reason we cannot despatch goods on a 1-2 day carrier we shall notify you at once to make alternative arrangements. If you would rather not wait for a revised delivery date you have the right to cancel your order. Offers on goods ex-stock are subject to goods being sold on receipt of acceptance.
The Delivery of Goods on the Drumshack website is currently restricted to the Great Britain only excluding Ireland and Northern Ireland. Prices for the delivery of goods to excluded areas can be made by application. All goods ordered are to the Cardholders registered address without exception, and we reserve the right to refuse any purchase which does not comply with this rule. All goods must be checked thoroughly on receipt before signing the courier’s delivery note and any receipt should be retained. Please check your goods thoroughly on receipt before signing carriers note and contact us immediately if there are any problems.
On all regular post, Courier 24 hour and Courier 48 hour deliveries, no specific time of delivery is stated within the day of delivery.

RETURNS
Under the United Kingdom Distance Selling Regulations 2000, you have the right to a cooling off period of 7 working days from the day after the day you receive the goods in which you can cancel the contract for the purchase of any goods from this website. A full refund will be made excluding any postage charges incurred for the return of the goods.
The goods must be complete and in the original boxes and packaging and free from any scratches or marks. Any free items must also be returned and media items such as dvds and videos should remain in the original packaging. We reserve the right to reduce the refund value if the returned goods have to be reduced for resale owing to missing or defective packaging.
No returns will be refunded unless you can provide proof of purchase. Special order items which were ordered specifically to you design cannot be refunded.
Second-hand goods carry a 7 Day Money Back Guarantee and no refund will be given unless they are return in the same condition as originally supplied.

LIABILITY FOR DEFECTIVE GOODS
We are prepared to replace free of charge or offer a full refund for any goods which are proved to be of defective manufacture or materials. Most items except consumables (i.e. Sticks and drum skins) are guaranteed for 12 months and we will act on your behalf to the manufacturer and whenever possible provide you with a loan item free of charge. We will not be liable to you for any loss of profits, administrative inconvenience, disappointment, indirect or consequential loss (apart from any loss within the contemplation of the parties at the time of the contract) or damage arising out of any problem in relation to the goods and we shall have no liability to pay any money to you by way of compensation other than any refund we make under these conditions.

This does not affect your statutory rights as a consumer, nor is it intended to exclude our liability for fraudulent misrepresentation or for death or personal injury resulting from our negligence.

CONTRACT FORMATION AND REFUSAL OF TRANSACTION
All products listings on this website amount to an advertisement only and placing an order by a customer constitutes to a contractual offer.

By sending an automated email reply in response to placing an order, we are not accepting the offer which has been made by the person who placed it.

Acceptance occurs either by a second confirmation email sent by us to the person who placed the order, or by actual posting of the ordered goods to the person who placed the order and at the same time processing that person’s card details for payment.

As a result of the above, after an order has been placed, we may refuse to process a transaction for any reason or refuse service to anyone before acceptance occurs at our sole discretion.

To purchase goods on the website you must be over 18 years old and provide your real name and telephone number. You must also provide an email address together with a proper postal address. You must also have a valid credit card or debit card.

LAW
The Conditions shall be governed by and construed in accordance with the laws of England and you irrevocably submit to the exclusive jurisdiction of the courts of England.
